These terms constitute a legally binding agreement between you ("User," "Client," or "you") and AK Digital LLC ("we," "us," or "our"). If you are acting on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.

AK Digital LLC provides digital marketing, CRM setup and management, paid advertising, and automation services. Our Full Package offering includes:

• Paid advertising campaigns (Facebook, Instagram, Google Ads)
• GoHighLevel (GHL) CRM setup, management, and automation
• Website design and development
• Lead generation and appointment booking automation
• Follow-up sequences and client communications via SMS, email, and phone

All services are provided as described at the time of engagement. AK Digital LLC reserves the right to modify, suspend, or discontinue any aspect of its services at any time with reasonable notice. Services are subject to the terms of any additional agreements, proposals, or contracts entered into between AK Digital LLC and the client.

The first month of service is offered free of charge as a trial period. If the services do not meet your expectations after the first month, you may discontinue without any financial obligation for that period. Subsequent months are billed as agreed upon in your service agreement.

AK Digital LLC sends Application-to-Person (A2P) SMS messages through registered 10-Digit Long Code (10DLC) numbers in compliance with CTIA guidelines and carrier requirements. By submitting your phone number and checking the consent checkbox on any AK Digital LLC form, you provide your express written consent to receive recurring automated text messages from AK Digital LLC.

Message frequency will vary based on your activity, engagement level, and the nature of your service agreement. You may receive up to 5 messages per week depending on your interaction with our services.

Standard message and data rates may apply depending on your mobile carrier and plan. AK Digital LLC is not responsible for any charges incurred from your wireless carrier in connection with SMS communications.

We do not share your mobile phone number with third parties for their own marketing purposes. Your number is used solely to facilitate the communications described above.

In compliance with the Telephone Consumer Protection Act (TCPA) and A2P 10DLC carrier requirements, AK Digital LLC obtains express written consent before sending any marketing or promotional SMS messages.

Consent is obtained at the point of form submission on our website. By checking the consent checkbox and submitting a form, you are providing express written consent to be contacted by AK Digital LLC via SMS text message at the phone number you provided.

Consent to receive SMS messages is not a condition of purchasing any goods or services. You may still engage with our services without providing SMS consent, and opting out at any time will not affect your access to services already contracted.

Your consent covers messages sent using automated technology, including automated dialing systems and pre-recorded messages, to the extent permitted by law.

You may revoke your consent and opt out of receiving SMS messages from AK Digital LLC at any time using any of the following methods:

Upon receipt of a STOP message, we will send a single confirmation message and then cease all SMS communications. Opting out of SMS does not cancel any active service agreements. You may re-subscribe at any time by texting START or by submitting a new consent form.

By using our website and services, you agree to:

• Provide accurate, truthful, current, and complete information in all forms and communications
• Notify AK Digital LLC promptly of any changes to your contact information
• Use our services only for lawful business purposes
• Not attempt to reverse-engineer, copy, or replicate any proprietary systems, workflows, or processes used by AK Digital LLC
• Not use our website or services to transmit harmful, unlawful, or fraudulent content
• Maintain the confidentiality of any login credentials or account access provided to you

You are solely responsible for any content, claims, or results arising from how you use the services, leads, or appointments generated on your behalf.

All content on this website — including but not limited to text, graphics, logos, design, code, and workflows — is the property of AK Digital LLC and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on this website without prior written permission from AK Digital LLC.

Custom work created specifically for a client (such as website designs, ad creatives, or CRM configurations) becomes the property of the client upon full payment for those services, unless otherwise specified in a separate written agreement.

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. AK Digital LLC does not warrant that:

• The website will be uninterrupted, error-free, or free of viruses or other harmful components
• Any specific results, leads, revenue, or business outcomes will be achieved through use of our services
• All information on the website is complete, accurate, or current at all times

While we strive to deliver positive results for every client, digital marketing outcomes are inherently variable and depend on factors outside our control, including market conditions, ad platform algorithms, and client industry.

To the fullest extent permitted by law, AK Digital LLC, its owner, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services or website, including but not limited to:

• Loss of revenue, profits, or business opportunities
• Loss of data or information
• Business interruption
• Costs of substitute services
• Any damages arising from reliance on information obtained through our website

AK Digital LLC's total cumulative liability to you for any and all claims arising from these terms or your use of our services shall not exceed the total amount you have paid to AK Digital LLC in the three (3) calendar months immediately preceding the claim.

You agree to defend, indemnify, and hold harmless AK Digital LLC and its owner, contractors, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from:

• Your use of or access to our website or services
• Your violation of these Terms & Conditions
• Your violation of any applicable law or third-party right
• Any inaccurate or misleading information you provide to us

Mobile carriers (including but not limited to AT&T, Verizon, T-Mobile, and others) are not liable for delayed, undelivered, or misdirected SMS messages. Message delivery is subject to the network conditions, policies, and technical limitations of your mobile carrier, all of which are outside the control of AK Digital LLC.

AK Digital LLC is not responsible for any carrier filtering, blocking, or throttling of messages that may occur as a result of carrier-level spam detection or compliance enforcement.

You must be at least 18 years of age to use our website, submit any form, or engage with any AK Digital LLC service. By using our services, you represent and warrant that you are at least 18 years old.

AK Digital LLC does not knowingly collect information from or market to individuals under 18. If we become aware that we have collected information from a minor, we will take steps to delete that information promptly.

These Terms & Conditions shall be governed by and construed in accordance with the laws of the United States and the state in which AK Digital LLC operates, without regard to conflict of law principles.

Any disputes arising from these terms or your use of our services shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules, and you waive any right to a jury trial or class action proceeding.

AK Digital LLC reserves the right to update or modify these Terms & Conditions at any time. When changes are made, we will update the "Last updated" date at the top of this page.

Continued use of our website or services after any changes constitutes your acceptance of the revised terms. We encourage you to review this page periodically. For material changes, we may provide additional notice via email or SMS where feasible.
